These Terms and Conditions apply to all services, bookings, purchases, workshops, events, and website use connected to Ah, Lovely! and www.ahlovely.com.

By booking a service, attending a session, purchasing a product or voucher, joining a workshop, or using this website, you agree to these Terms and Conditions.

2. Services

Ah, Lovely! offers colour analysis and related services, including but not limited to:

Personal colour analysis sessions.

Duo colour analysis sessions.

Small group workshops.

Corporate workshops and events.

Colour, style, image, and self-expression related advice.

Gift vouchers, if offered.

Digital or physical materials, if offered.

The exact content, duration, price, and deliverables of each service are described on the website, booking page, proposal, invoice, or written agreement.

3. Nature of the service

Ah, Lovely! provides colour analysis, image-related advice, and educational or reflective content around colour, style, self-expression, and personal presentation.

Although the business may draw on psychological knowledge and communication concepts, the services are not medical care, psychological treatment, psychotherapy, diagnosis, mental health counselling, or any form of clinical intervention.

Nothing on the website, during a session, or in a workshop should be understood as medical, psychological, legal, financial, or professional clinical advice.

If you need medical, psychological, or mental health support, you should contact a qualified healthcare professional.

4. Booking and formation of the agreement

A booking is confirmed when you complete the booking process and receive written confirmation, or when Ah, Lovely! confirms the booking by email or another written message.

For corporate events, workshops, or custom services, the agreement is formed when you accept the proposal, confirm the booking in writing, or pay the invoice or deposit.

You are responsible for providing accurate information when booking, including your name, contact details, preferred date, number of participants, and any relevant practical information.

Ah, Lovely! may refuse or cancel a booking if the information provided is incomplete, incorrect, or if the service is not suitable for the request.

5. Prices

All prices are stated in euros.

Prices are shown on the website, booking page, invoice, or proposal.

Unless stated otherwise, prices include VAT where VAT is applicable.

Ah, Lovely! may change prices at any time. Price changes do not affect bookings that have already been confirmed, unless both parties agree otherwise.

For corporate events, group workshops, or custom services, a separate quote may be provided. The quote is valid for the period stated in the quote. If no validity period is stated, the quote is valid for 14 days.

6. Payment

Payment must be made according to the payment instructions provided during booking, on the invoice, or in the written agreement.

Depending on the service, payment may be required in full at the time of booking, by deposit, or by invoice before the session or event.

If payment is not received on time, Ah, Lovely! may postpone or cancel the booking.

For business clients, invoices must be paid within the payment term stated on the invoice. If no payment term is stated, payment is due within 14 days of the invoice date.

Any payment processing fees, bank charges, or currency conversion fees charged by your bank or payment provider are your responsibility, unless otherwise required by law.

7. Right of withdrawal for consumers

If you are a consumer and you book or buy a service online, by email, by telephone, or otherwise at a distance, you may have a statutory right of withdrawal of 14 days.

This means you may cancel the agreement within 14 days after the agreement was made, without giving a reason.

To exercise your right of withdrawal, you must inform Ah, Lovely! clearly in writing, for example by email, that you wish to withdraw from the agreement.

You may use the model withdrawal form at the end of these Terms and Conditions, but this is not required.

If you validly withdraw within the statutory withdrawal period, Ah, Lovely! will refund payments received from you within 14 days after receiving your withdrawal request.

8. Services within the withdrawal period

If you book a service that takes place within the 14-day withdrawal period, you agree that Ah, Lovely! may begin providing the service before the withdrawal period has ended.

If the service has already been fully provided within the withdrawal period, and you gave prior consent for the service to begin during that period, you lose the right to withdraw once the service has been fully completed.

If you withdraw after the service has already partly started, you may be required to pay a reasonable amount for the part of the service already provided, where this is allowed by law.

9. Cancellation and rescheduling by the client

The statutory right of withdrawal described above applies where legally required.

Outside the statutory withdrawal period, the following cancellation and rescheduling policy applies unless otherwise agreed in writing.

For personal colour analysis sessions and duo sessions:

You may reschedule once free of charge if you give at least 48 hours’ notice.

If you cancel at least 7 days before the session, you will receive a full refund, unless a non-refundable deposit or administrative fee was clearly agreed before booking.

If you cancel between 48 hours and 7 days before the session, Ah, Lovely! may charge 50% of the session fee.

If you cancel less than 48 hours before the session, the full session fee may be charged.

If you do not attend the session without giving notice, the full session fee may be charged.

For small group workshops:

If you cancel at least 14 days before the workshop, you will receive a full refund.

If you cancel between 7 and 14 days before the workshop, Ah, Lovely! may charge 50% of the workshop fee.

If you cancel less than 7 days before the workshop, the full workshop fee may be charged.

You may transfer your place to another person if you inform Ah, Lovely! in advance and the replacement participant provides the necessary details.

For corporate events and custom workshops:

Cancellation and rescheduling terms will be stated in the proposal, invoice, or written agreement.

If no separate terms are agreed, cancellation more than 14 days before the event may be refunded minus any costs already incurred.

Cancellation between 7 and 14 days before the event may be charged at 50% of the agreed fee.

Cancellation less than 7 days before the event may be charged at 100% of the agreed fee.

Any venue, travel, material, printing, preparation, or third-party costs already incurred may be charged separately.

10. Late arrival

Please arrive on time for your session or workshop.

If you are late, Ah, Lovely! will try to provide the remaining part of the session within the scheduled time. The session may not be extended if this affects later appointments or other commitments.

If you are more than 20 minutes late without prior notice, this may be treated as a no-show and the full fee may be charged.

11. Cancellation or changes by Ah, Lovely!

Ah, Lovely! may cancel, reschedule, or adjust a booking if necessary due to illness, emergency, force majeure, unsafe conditions, insufficient workshop participants, or circumstances outside reasonable control.

If Ah, Lovely! cancels a confirmed paid session or workshop and no suitable replacement date can be agreed, you will receive a refund for the amount paid for that service.

Ah, Lovely! is not responsible for additional costs you may incur, such as travel, childcare, accommodation, or lost income, unless required by law.

12. Client responsibilities

You are responsible for providing accurate and complete information before and during the service.

You are responsible for your own choices after receiving colour, style, image, or self-expression advice.

Ah, Lovely! cannot guarantee that a particular colour palette, style recommendation, outfit, or presentation choice will create a specific personal, social, professional, emotional, or financial result.

Colour analysis involves professional judgement and interpretation. Results may differ between systems, lighting conditions, analysts, methods, or personal preferences.

13. Health, allergies, and accessibility

If you have allergies, accessibility needs, mobility requirements, sensory sensitivities, or other practical needs that may affect your session or attendance at a workshop, please inform Ah, Lovely! in advance.

Ah, Lovely! will try to make reasonable adjustments where possible, but cannot guarantee that every request can be accommodated.

Tea, coffee, snacks, or refreshments may be offered during sessions or workshops. You are responsible for informing Ah, Lovely! in advance of any allergies or dietary restrictions.

14. Materials and deliverables

Depending on the service booked, you may receive physical or digital materials, such as a colour palette, colour passport, summary, worksheet, guide, or other supporting material.

These materials are for your personal use only.

You may not copy, reproduce, distribute, resell, publish, teach from, or commercially use Ah, Lovely! materials without prior written permission.

Colours may appear differently depending on screen settings, printer settings, lighting, fabric, paper, and production method. Ah, Lovely! aims to provide useful and accurate materials but cannot guarantee exact colour reproduction in every context.

15. Gift vouchers

If Ah, Lovely! offers gift vouchers, the voucher terms will be stated at the time of purchase.

Unless stated otherwise, gift vouchers are valid for 12 months from the purchase date.

Gift vouchers cannot be exchanged for cash.

If the price of the chosen service increases after the voucher was purchased, the recipient may need to pay the difference, unless otherwise agreed in writing.

Lost or stolen gift vouchers may not be replaced unless Ah, Lovely! can verify the original purchase and unused balance.

16. Digital products or downloadable materials

If Ah, Lovely! offers digital products or downloadable materials, you will receive access as described at the time of purchase.

Digital products are for personal use only, unless a commercial licence is clearly provided.

You may not share, resell, copy, distribute, or publish digital products or downloads without written permission.

For digital content supplied immediately after purchase, you may be asked to consent to immediate delivery and acknowledge that you may lose your statutory right of withdrawal once the download or digital delivery begins.

17. Intellectual property

All website content, text, images, branding, colour materials, workshop content, guides, worksheets, methods, presentations, and other materials created by Ah, Lovely! are protected by intellectual property rights.

You may view and use the website and materials for personal, non-commercial purposes only.

You may not copy, reproduce, modify, distribute, sell, publish, or use Ah, Lovely! content for commercial purposes without prior written permission.

18. Photos, testimonials, and marketing

Ah, Lovely! will not use identifiable photos, videos, testimonials, or personal stories for marketing without your permission.

If you give permission, you may withdraw it later by contacting Ah, Lovely!.

Withdrawal does not affect any lawful use that took place before the withdrawal, but Ah, Lovely! will stop future use where reasonably possible.

19. Privacy

Ah, Lovely! processes personal data in accordance with the Privacy Policy available on the website.

The Privacy Policy explains what personal data is collected, why it is used, how long it is kept, and what rights you have.

20. Website use

You may use the website for lawful personal purposes.

You may not misuse the website, attempt to damage it, interfere with its security, copy its content without permission, or use it in a way that violates applicable law or the rights of others.

Ah, Lovely! aims to keep the website accurate and available, but cannot guarantee that the website will always be error-free, complete, secure, or uninterrupted.

21. Third-party links and tools

The website may contain links to third-party websites or tools, such as booking systems, payment providers, social media platforms, embedded content, or external resources.

Ah, Lovely! is not responsible for the content, availability, privacy practices, or terms of third-party websites or services.

You should review the terms and privacy policies of those third parties before using them.

22. Complaints

If you are dissatisfied with a service, please contact Ah, Lovely! as soon as possible by email.

Please describe the issue clearly and include relevant details, such as the date of the session, workshop, or booking.

Ah, Lovely! will try to respond within 14 days.

Submitting a complaint does not automatically suspend your payment obligation, unless required by law or agreed in writing.

23. Liability

Ah, Lovely! will provide services with reasonable care and skill.

Ah, Lovely! is not liable for indirect loss, consequential loss, emotional distress, loss of income, loss of business, missed opportunities, reputational damage, or costs resulting from personal choices made after a session, workshop, or website visit.

Ah, Lovely!’s total liability is limited to the amount paid by you for the specific service to which the claim relates, unless the law does not allow such a limitation.

Nothing in these Terms and Conditions excludes liability where this is not permitted by law, including liability for intentional misconduct or gross negligence.

24. Force majeure

Ah, Lovely! is not responsible for failure or delay in performing obligations caused by circumstances outside reasonable control.

This may include illness, accidents, family emergencies, extreme weather, transport disruption, strikes, fire, flood, government measures, power outages, internet failure, venue problems, or other events beyond reasonable control.

If force majeure occurs, Ah, Lovely! will try to offer a reasonable solution, such as rescheduling the service.

25. Changes to these Terms and Conditions

Ah, Lovely! may update these Terms and Conditions from time to time.

The latest version will be available on the website.

The version that applies to your booking or purchase is the version that was available at the time your booking or purchase was confirmed, unless a later version is required by law or both parties agree otherwise.

26. Governing law and disputes

These Terms and Conditions are governed by Dutch law.

If a dispute arises, both parties will first try to resolve it through reasonable communication.

If the dispute cannot be resolved, it may be submitted to the competent court in the Netherlands, unless mandatory consumer law gives you the right to choose another court.
